What is the minimum annual leave required in India?
Under most state Shops & Establishments Acts, the minimum annual leave is typically 12-18 days per year (1 day for every 20 days worked). Some states mandate up to 22 days. The exact minimum varies by state — Karnataka and Maharashtra require 1 day per 20 days worked, while Delhi mandates 1 day per 15 days worked in certain establishments.
What is the difference between annual leave, sick leave, and casual leave?
Annual Leave (also called Privilege Leave) is planned time off for vacations or personal needs — it accrues and can be carried forward. Sick Leave is for illness or medical needs — often requires a certificate for absences over 2 days. Casual Leave is for short-notice, unforeseen needs — typically 5-7 days per year and cannot be carried forward or combined with other leave.
Can employees carry forward unused leave?
Annual/privilege leave can typically be carried forward, usually capped at 30-60 days. Sick leave and casual leave are almost always 'use-it-or-lose-it' — they cannot be carried forward or encashed at the end of the year. Some companies allow a one-time carry-forward with manager approval.
What is the standard probation period in India?
The standard probation period in India is typically 3 to 6 months, extendable up to 12 months depending on the role and company policy. During probation, employees are entitled to statutory leave accruals from day one, though many companies restrict using annual leave until after confirmation.
Is maternity leave mandatory in India?
Yes, under the Maternity Benefit Act, 1961 (as amended), eligible women employees are entitled to 26 weeks of paid maternity leave for the first two children (12 weeks for third child onwards). This applies to establishments with 10+ employees. Employees must have worked for at least 80 days in the 12 months preceding delivery.
